We (Argevide Sp. z o.o. based in Gdańsk, Poland, at Jaśkowa Dolina 6/3) will provide You with access to PREMIS Free Service (“Service”) on the following Terms and Conditions:
1. The Service
We grant You access to the Service for your user account identified by Your email address.
The scope of Service functionality is limited and You will not have access to some features which are available in the paid PREMIS Service.
The Service is free and there are no fees for use of the Service.
The service is available only to persons aged 18 and over. You cannot use the Service if you are under 18 years of age.
A web browser is necessary to use the Service. We recommend Google Chrome and Microsoft Edge. Cookies and JavaScript must be enabled in your web browser to use the Service. You are solely responsible for the correctness and legality of the data You enter or upload to the Service (“Content”) . You may not, in particular, enter and store unlawful Content in the Service as well as use the Service for purposes that are contrary to or intended to circumvent the law.
We process and store personal data in accordance with “Argevide Privacy Policy and Information on Personal Data Processing under General Data Protection Regulation (GDPR)”.
2. Term and Termination
Your access to the Service may be terminated if You do not log in to the Service for a period of more than six months. You have the right to terminate the use of the Service at any time. In such case your user account will be disabled and then removed from the Service.
We may terminate the Service in case We receive information about Your actions which violate these Terms and Conditions or applicable laws.
3. Notifications
You agree to receive email notifications from the Service and information about new versions of the Service.
After Service termination You will receive notification that your access to the Service is closed and no further emails will be sent to Your email address.
4. Limitations
The Service is provided “as is”, without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and noninfringement. in no event shall the authors or copyright holders be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the Service or the use or other dealings in the Service.
We shall not be liable for any indirect, incidental or consequential damages including but not limited to loss of profits, loss of goodwill or missed opportunities that may be caused by or related to the use of the Service.
5. Security of the Service
You mat not defeat, nor attempt to defeat, any security measures built into the Services You may not use and will be responsible for any consequences of the use of any malicious software or devices that violate the Service security.
We continuously monitor the Service to facilitate its operation and address illegal acts or violations. The monitoring tools do not collect or store any of Your Content residing in the Service, except as needed for such purposes.
6. Intellectual Property Rights
The Service and software used to provide the Service are protected by international intellectual property laws and treaties. All rights are reserved.
You will not reverse engineer, decompile, disassemble, decipher, decrypt, or otherwise seek to discover or obtain the source code or non-public Service interfaces, except to the extent expressly permitted by applicable law.
7. Governing Law
These Terms and Conditions will be governed by and interpreted in accordance with the laws of Poland. The United Nations Convention on Contracts for the International Sale of Goods will not apply.
Any dispute, controversy or claim arising out of or relating to this Agreement and not resolved by the Parties will be settled by the courts in Gdańsk, Poland.
8. Severability
In the event any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of any of the remaining provisions shall not in any way be affected or impaired.
9. Final provisions
Argevide reserves the right to update these Terms and Conditions.
The Terms and Conditions will apply from 1 July 2024.
